Terms & Conditions of Booking
Below is the full wording of our terms and conditions of booking. Please read this carefully before confirming any booking with Bayan Blue.
Your contract is with Bayan Blue Ltd. Rigbey Harrison, Church Green East, Redditch, Worcestershire, B98 8BT. Upon making a booking, you agree to these terms and conditions. The contract, which is made on acceptance of the booking confirmation, is based on these terms and conditions and is subject to the jurisdiction of the English courts. The departure date is the date of arrival in Greece.
Your Financial Protection
In compliance with the UK Package Travel, Package Holidays and Package Tours Regulations 1992 an insurance policy has been arranged with Travel & General Insurance Company plc to protect customers' prepayments paid in respect of
- non-flight inclusive packages commencing and returning to the UK
- the ground handling aspects of packages where the customer is responsible for arranging travel to the destination
offered on this website (subject to the terms of the insurance policy), for:
- a refund of such prepayments if customers have not yet travelled
- making arrangements to enable the holiday to continue if customers have already travelled
in the unlikely event of our financial failure.
Booking Information
Please check your booking confirmation for errors and discrepancies, as this information is used to facilitate your holiday. Any errors on the booking confirmation should be notified to Bayan Blue Ltd. within 7 days of receipt, or, if the departure date is less than 14 days from the date of issue, within 24 hours. After this period, the booking confirmation is deemed to have been accepted. The contract is between the party leader and Bayan Blue Ltd. The guest information requested is necessary to complete paperwork relating to your holiday. This must be completed 10 weeks prior to your departure date, or, if the departure date is less than 10 weeks after booking, within one week of the request. If the departure date is less than a week from booking, the information must be supplied within 24 hours and at least 48 hours prior to departure. If this is not possible, the party leader must contact us before departure. Any delays to your holiday as a result of incomplete or inaccurate details are out of our control and no compensation will be paid. The information supplied forms part of the contract between us.
Pricing & Payments
The price of the holiday is as stated in the Pricing Plan page and is in pounds sterling. These prices supersede any previous price lists and are subject to change. Once you have paid a 30% deposit, the price will not normally be subject to change. Any offers and discounts available cannot be applied retrospectively. The balance of your holiday must be paid at least 10 weeks before departure. If there is less than 10 weeks between the issue of your booking confirmation and the departure date, the balance must be paid in full with the deposit. Late payment of the balance may incur a 0.5% per week surcharge.
Changes to your Holiday by You
Minor changes to your holiday (for example, the substitution of one guest for another, or addition or removal of a guest) may be possible provided 14 days notice is given. Any requests for changes must be authorized by the party leader and may be subject to a £10 administration fee. Any additional guests will be charged for as per published prices. If, after receipt of your booking confirmation, you wish to change the date or duration of your holiday, we will do our utmost to assist you. However, changes may not be possible. The cost of any changes will be the additional holiday cost (if any), based on the brochure prices and may also be subject to a 2% administration fee. Changes made within 8 weeks of departure are treated as a cancellation and re-booking. The party leader may cancel your holiday at any time. The charge for cancelling your holiday is dependent on the notice given:
- More than 10 weeks notice: deposit only.
- 6-10 weeks notice: 50% of total holiday cost.
- 2-6 weeks notice: 80% of total holiday cost.
- Less than 2 weeks notice: 100% of holiday cost.
If the reason for cancellation is covered by your insurance policy, you may be able to reclaim any charges.
Changes to Your Holiday by Us
We reserve the right to make changes, or cancel your holiday as necessary. Most changes are minor and you will be notified as soon as possible. Major changes include (but are not limited to):
- A change of holiday date.
- A change of holiday duration.
- A change of villa.
- Cancellation of the holiday
If we have to make a major change to your holiday, you are entitled to either accept our offer of a replacement or accept a full refund of the money you have paid. In all cases, excepting changes due to Force Majeure, we will compensate your party as follows:
- More than 10 weeks notice: £15 per party.
- 6-10 weeks notice: £30 per party.
- 2-6 weeks notice: £60 per party.
- Less than 2 weeks notice: £120 per party.
No compensation will be paid if the change is due to Force Majeure. Force Majeure means unforeseen and unusual circumstance beyond our control, the consequences of which could not have been avoided even if all due care is exercised. Examples are riot, civil strife, unavoidable technical problems, terrorist activity, natural disasters, fire, acute medical problems or adverse weather conditions. Please note that this list is not exhaustive.
Your Accommodation
Your accommodation is available exclusively for your party (as named on the booking confirmation). No-one else is allowed to stay, unless you have prior agreement from us. This may incur an additional charge. We ask you to respect the property you are living in and reserve the right to charge for any breakages (other than accidental) or for any exceptional cleaning required on departure.
Behaviour
We ask you to be considerate to both the local Greeks and your fellow holidaymakers. We reserve the right in our absolute discretion to terminate without further notice the holiday arrangements of any guest who refuses to comply with the instructions of our staff. Upon termination our responsibility to you ceases and we shall not be liable for any further costs incurred by the guest. You may be liable for any costs we incur as a result of your behaviour. Parents are responsible for the actions of their children at all times.
Holiday Insurance
Travel insurance is essential and we may ask you to provide details of your policy. Please ensure that any insurance covers all activities envisaged while on holiday. We recommend any insurance policy purchased has a 24-hour emergency telephone number.
Health and Safety
Please take good care of your personal possessions. Crime is not a big problem in Greece, but you should take adequate precautions. If you loose any items of value, you should report this to the local police and obtain a written report. Without this is may not be possible to claim through your travel insurance.
Local Activities
Bayan Blue Ltd. may provide information in the villas relating to local activities. These are for guests' information only and we do not act as an agent for these services. We will not be liable for any complaints, claims, loss or damages relating to these activities.
Villa Services and Maintenance Staff
Water, gas and electricity are included in the villa rental cost. Some of our villas are in remote locations and may suffer water shortages or power cuts. We ask for you patience and co-operation in these instances as this is out of our control. Our properties are maintained by local staff and to keep a villa running all season, there may be occasions when staff need access to pools or gardens during your holiday. Any disruption will be kept to a mimimum (for example, pools may be checked in the early mornings), but we ask our guests to be sympathetic to this.
Travel Advice
At the time of writing (August 2007), no vaccinations are required for British Citizens visiting Greece. However, we strongly recommend that you obtain and read a copy of The Department of Health booklet T6, Health Advice for Travellers. If you are travelling to Greece, we recommend you obtain an EHIC (the replacement for the old E111), which will assist in receiving emergency medical treatment in an EU country.
